Terms of service

Last updated: {{ last_updated }}

These Terms of Service ("Terms") govern your access to and use of {{ shop_name }} (the "Store"), operated from Switzerland. By accessing the Store, placing an order, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Store.

1. About Us

{{ shop_name }} is an online store based in Switzerland. You can contact us at {{ email }}{% if address != blank %} or at {{ address }}{% endif %}.

2. Eligibility

You must be of legal age in your jurisdiction, or have the consent of a parent or guardian, to place an order with us.

3. Products and Availability

We make reasonable efforts to display our products, including colours and descriptions, as accurately as possible. However, we do not warrant that product descriptions, images, or other content are accurate, complete, or error-free. All products are subject to availability, and we reserve the right to limit quantities, discontinue products, or correct errors in pricing or descriptions at any time, including after an order has been submitted.

4. Prices and Payment

All prices are displayed in Swiss Francs (CHF) unless otherwise stated, and are subject to change without notice. Applicable taxes, duties, and shipping costs will be calculated and displayed at checkout. Payment must be made in full at the time of ordering through the payment methods offered at checkout. We use third-party payment processors to handle payment information; we do not store full payment card details ourselves.

5. Orders and Contract Formation

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, pricing errors, or product unavailability. A contract is formed only once we confirm your order by email or equivalent notice.

6. Shipping and Delivery

Please refer to our Shipping Policy for information on delivery times, costs, and international shipments, including customs and import duties for orders shipped outside Switzerland.

7. Returns, Exchanges, and Right of Withdrawal

Please refer to our Refund Policy for details on returns, exchanges, and — where applicable — your statutory right of withdrawal under EU consumer protection law.

8. Intellectual Property

All content on the Store, including text, graphics, logos, images, product designs, and software, is the property of {{ shop_name }} or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

9. User Conduct

You agree not to use the Store for any unlawful purpose, to interfere with the operation of the Store, to attempt unauthorized access to our systems, or to submit false or misleading information when placing an order.

10. Limitation of Liability

To the fullest extent permitted by applicable law, {{ shop_name }} shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Store or our products. Nothing in these Terms limits liability that cannot be excluded under applicable mandatory law, including statutory liability for gross negligence, wilful misconduct, or, where you qualify as a consumer under EU law, mandatory consumer protection rights.

11. Consumer Rights (EU/EEA and UK Customers)

If you are a consumer resident in the European Union, European Economic Area, or United Kingdom, these Terms do not affect any mandatory statutory rights you have under the consumer protection laws of your country of residence, including rights that cannot be waived or limited by contract.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect once posted on this page, with the "Last updated" date revised accordingly. Continued use of the Store after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer resident in the EU/EEA or UK, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence. Any disputes shall be submitted to the competent courts at the registered seat of {{ shop_name }} in Switzerland, without prejudice to any mandatory consumer jurisdiction rules that entitle you to bring proceedings in your own country of residence.

14. Contact

For any questions about these Terms, please contact us at {{ email }}{% if address != blank %} or at {{ address }}{% endif %}.
